Scratch and Win Promotion - Participant Terms & Conditions


These terms and conditions ("Terms and Conditions") apply to the Graham SCRATCH AND WIN Promotion (the "Promotion"). Please read these Terms and Conditions carefully and make sure that you understand them before participating in the Promotion. By registering your details for the Promotion at www.Grahampromo.co.uk ("Website"), you, for and on behalf of the Participant (as defined below) agree to be bound by the Terms & Conditions set out below.


1 The Promotion

1.1 The Promotion is operated by and on behalf of Graham, a trading name of Jewson Ltd (“Graham”) Registered Office: Saint-Gobain House, Binley Business Park, Coventry, CV3 2TT. Company Registration Number: 00348407

1.2 The Promotion commences on 1st October 2016 and ends on 31st December 2016 (the “Promotional Period”). Should the Promotion be extended, customers will be notified by in-branch communication.

1.3 The Promotion is only open to existing Graham Trade Credit Account and Trade Cash Account holders who have made a valid purchase of a Boiler Replacement Pack (details available in branch and at http://www.Grahamplumbersmerchant.co.uk/tools/online-literature) with a matching invoice number for the purchase - (the “Participant(s)”).

1.4 The Promotion excludes and is not available to:

1.4.1 any and all other Trade Account or Trade Cash Card holders of other brands of Saint Gobain

1.4.2 any and all current and previous employees of Graham or their immediate families or public sector and housing association employees; and

1.4.3 any and all employees of any agencies or event suppliers or their families or agents or any other person officially connected with the Promotion.

1.5 In order to participate in the Promotion, Participants must be Graham Account Holders, have made a valid purchase of a Boiler Replacement Pack and have a valid invoice number for the purchase.

1.6 No third party or joint entries will be accepted.

2 Participants

2.1 If, as the Participant in the Promotion, you are acting as an individual or partnership you must be resident in the UK and remain resident throughout the Promotional Period and be aged 18 or over at the date of the commencement of the Promotion.

2.2 Where you are entering as a Participant on behalf of a limited company, you:

2.2.1 must be aged 18 or over;

2.2.2 confirm, by completing the online claim form on the Website, that you:

2.2.2.1 have the authority to bind the Participant on whose behalf you complete the online registration (i.e. the Graham Trade Credit Account and Trade Cash Account holder); and

2.2.2.2 have made the Participant aware of the Promotion and have its consent to enter into the Promotion on its behalf.

2.3 It is a condition of entry that all information given in the entry form is true, current and full. It is the Participant’s obligation to update any information submitted upon registration. Graham will not be liable for any breach of the terms and conditions arising from the Participant’s failure to update the information submitted.

2.4 If the Participant fails to provide all of the requested and required information, including a valid invoice for the Boiler Replacement Pack, the Participant is disqualified and is not allowed to participate in the Promotion nor redeem their reward. Graham is not responsible for incomplete, unclear, incomprehensible or distorted entries. Such entries will be void.

2.5 Graham reserves the right at its sole discretion to eliminate and deem invalid any entries which we suspect to have been submitted using scripts, automated systems, or via a third party for commercial gain.

2.6 The Promoter reserves the right at its sole discretion to eliminate or disqualify any entries or entrants that it regards as being in breach of these conditions or the spirit of the Promotion.

3 The Promotion

3.1 After each purchase participants will receive a printed scratch card that will reveal if they are a winner and an 8-digit code, which should be used to reveal their prize online. To find out their prize the Participant must go to www.Grahampromo.co.uk (the Website) and register their details. This is an online Promotion and internet access and email addresses are required to participate.

3.2 Participants may enter the Promotion as many times a day as they wish as long as they have a valid scratch card code for each entry. Each code is unique and can only be used once.

3.3 The Rewards

3.3.1 Main Rewards: The main prizes are holidays up to the value of £5,000 or £1,500. The winners will be provided with a voucher to use when booking their holiday. The voucher can be used at a range of tour operators including Virgin Holidays, Thomas Cook, Thomson, Airtours, Kuoni). Graham and their partners are unable to guarantee these operators as they are subject to change. Main prizes are supplied by, and are the responsibility of the promoter’s partners.

3.3.2 Runner’s Up Rewards: A great selection of other prizes are available. These include: £5, £10, £25, £50 and £100 digital retail voucher codes for Starbucks, Great British Pub Company, Argos, John Lewis, Currys / PC World, i-tunes, Cafe Rouge, Bella Italia and Belgo (Restaurant Card). There are also a range of leisure vouchers including free accommodation (purchase necessary), buy 1 get 1 free golf, buy 1 get 1 free or discounted adrenalin activities and buy 1 get 1 free or discounted days out vouchers. A purchase at the venue is necessary with all leisure vouchers, full details will be provided to each winner.

3.4 All prize allocations will be selected at random.

3.5 If a Boiler Replacement Pack Order is cancelled by the Participant (even after the expiry of the Promotional Period) and the reward has not been redeemed in full Graham reserves the right to cancel the reward.

If a Boiler Replacement Pack Order is cancelled by the Participant (even after the expiry of the Promotional Period) and the reward has been redeemed in full Graham reserves the right to reimbursement from the participant.

3.6 Graham reserves the right to modify scheduling of any aspect of the Promotion without prior notice at any time and for any reason.

3.7 Graham further reserves its rights to substitute any Reward of equivalent value in the event of circumstances outside its control.

4 Claiming a Reward

4.1 Reward Notification

Main Rewards - winning Participants shall be notified of their prizes by email within 4 working days of being notified of being successful. They shall receive a voucher to be redeemed when they wish to book their holiday.

Runner’s Up Rewards - winning Participants shall receive their prizes by email within 4 working days of being notified of being successful.

4.2 The Promoter or Partner will take all reasonable steps to contact the winning entrants to arrange for the delivery of their prize, but should there be no response to contact emails or (where the mobile number is known) text messages, the Promoter will withdraw the prize.
4.3 The Reward cannot be transferred, refunded, exchanged, sold or in any way traded. No cash equivalent is available.

4.4 The Redemption Period closes 1 month after the Promotion. The aim is to complete all Customer redemptions of Incentives by 31 January 2017.

4.5 For the avoidance of doubt, Rewards earned by a business holding a Trade Credit Account and / or a Trade Cash Account shall be for the benefit of the named account holder and not any other individual. It is for the named account holder (i.e. the Participant) to nominate who is to receive the Reward, at the time the online claim form is submitted.

4.6 Any Rewards that individuals from the Participant’s business receive are received purely in the capacity of an agent, acting on behalf of your business. Any decision entitling individuals to be the recipient of Rewards rests with your business and not with Graham.

4.7 Rewards shall only be permitted to go ahead if, prior to redemption, (i) the Participant can produce a valid invoice number for the purchase of the Boiler Replacement Pack by the named account holder and (ii) has no outstanding invoices attributable to the Promotional Period; and (iii) their Trade Credit Account or Trade Cash Account has not been suspended by GRAHAM due to non-payment/legal issues.

4.8 The Participant agrees to make an individual participating in or receiving a Reward on its behalf, aware of these terms and conditions.

4.9 All persons attending, participating in or receiving a Reward may be required to enter into a waiver of responsibility and by attending, participating in or receiving a Reward, such individuals agree to be bound by these terms and conditions.

4.10 The decision of the Promoter is final and no correspondence will be entered into.

5 Liability

5.1 Subject to clause 5.2

5.1.1 Graham shall under no circumstances whatsoever be liable to the Participant or any individuals selected by the Participant to receive a reward, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Promotion or the participation in the Promotion of any Participant or any individual selected by the Participant to receive a reward; and

5.1.2 Graham accepts no responsibility for any loss or damage caused by the negligence of Graham, its servants or agents out of or in connection with this Promotion except where caused by wilful neglect of Graham, its employees or agents.

5.2 Nothing in these terms and conditions excludes or limits Graham’s liability for:

5.2.1 death or personal injury resulting from the negligence of Graham, its employees or agents;

5.2.2 fraud or fraudulent misrepresentation; or

5.2.3 any matter in respect of which it would be unlawful for Graham to exclude or restrict liability.

5.3 The Participant hereby agrees to release and to hold Graham (and its employees, officers, directors, agents, marketing partners and affiliates) harmless from any and all losses, damages, rights, claims and actions of any kind in connection with or arising from:

5.3.1 any breach of these terms and conditions by the Participant or any person it selects to receive the Reward, and

5.3.2 the delivery, acceptance and/or subsequent use or misuse of any Reward.

5.4 Graham will not accept liability for change to the venue/events due to decisions by the event organisers or suppliers of any reward. Graham or the event organisers or suppliers of any reward reserves the right to change the venue and/or dates for a reward and/or the actual Reward at any point and will provide an alternative venue, date and/or Rewards of equal value. Graham accepts no responsibility for any loss incurred as a result of these changes.

5.5 No cash equivalent shall be provided for the Rewards.

5.6 Graham and their partners will undertake to use reasonable efforts to maintain adequate email, internet and other communication links but is not otherwise responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible registrations; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, delays or difficulties; (iii) errors in transmission; or (iv) reward redemption deliveries attempted but not received. If you are disqualified, Graham or their suppliers are under no obligation to publish this fact on the Website or anywhere else.

6 Taxes

6.1 The Participant acknowledges and agrees that accepting a Reward may be subject to Tax and National Insurance. The Participant shall be fully responsible for and shall indemnify Graham for and in respect of any income tax, National Insurance and social security contributions and any other liability, deduction, contribution, assessment or claim arising from or made in connection with receipt by the Participant or any individual selected by it of a Reward. 7 Termination of the Promotion

7.1 Graham reserves the right to amend, suspend or withdraw this Promotion or any Reward in whole or in part at any time without prior notice or compensation at any time.

8 Winning Participants

8.1 A list of the successful Participants, by first name and County, can be obtained by sending a SAE to A&I Motivation, One Lea House, 211 Loughborough Road, Mountsorrel, Leicestershire, LE12 7AR.

9 Data Protection and Publicity
9.1 By participating in the Promotion, the Participant and any individual who receives any Reward at the direction of the Participant consent to:

9.1.1 Graham processing the Participant’s and any such individual’s data; and

9.1.2 the Participant’s and any such individual’s name, details and/or photographs appearing in publicity material or other events relating to the Promotion.

9.2 The Participant may be asked to participate in future publicity or PR activities, which may involve taking photographs. The Participant shall use it best endeavours to participate in such activities and procure that any individuals selected by it to receive any Reward participate in such activities.

9.3 The Website may contain links to other websites, including those belonging to Graham partners or Social Media Websites. These links are provided for convenience and are not under the control of the Promoter and as such we make no warranty, either expressed or implied, concerning the content of such sites including any claims of infringement or that such sites content are devoid of viruses.

10 Additional Terms and Conditions

10.1 The Rewards are supplied by third party partners and suppliers, the receipt of a Reward by the Participant or any individual selected by it will be subject to such supplier’s terms and conditions.

11 General Conditions

11.1 Graham (and its employees, officers, directors, agents, marketing partners, affiliates, partners or suppliers) shall not be in breach of these terms and conditions or be liable for any disruption to the Promotion or a Reward, or any delay in performing or failure to perform, any of its obligations under these terms and conditions if such disruption, delay or failure results from events beyond the reasonable control of Graham.

11.2 Graham reserves the right to vary these terms and conditions or cancel the Promotion at any stage in the event of circumstances arising beyond its reasonable control.

11.3 No failure or delay by Graham to exercise any right or remedy provided under these terms and conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

11.4 No-one other than Graham and the Participant, their successors and permitted assignees, shall have any right to enforce any of these terms and conditions.

11.5 These terms and conditions, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, English law, and the English courts shall have exclusive jurisdiction over any proceedings in connection with these terms and conditions and the Graham Promotion.

11.6 Your statutory rights are not affected by any of the above terms and conditions.
